Terms of Service

1. Acceptance of Terms

By signing in to Poems Dimension Back Stage (the "Application" or "App"), you hereby acknowledge and agree to be bound by these Terms of Service in their entirety. If you do not agree to these Terms, you must not access or use the Application.

2. User Eligibility

Access to the Application is strictly restricted to individuals who have been approved by a Poems Dimension administrator and added to the authorized user allowlist.

Strictly Prohibited Activities:

• Sharing your login credentials with any third party
• Attempting to circumvent, bypass, or manipulate the allowlist system
• Facilitating unauthorized access by any means

3. Permitted Use

The Application is provided exclusively for scheduling rehearsal and performance rooms within Poems Dimension. By using the Application, you covenant and agree to:

• Create bookings only for rooms you genuinely intend to use
• Cancel reservations promptly when your plans change or no longer require the booking
• Respect the reservations and scheduled time of other authorized users
• Refrain from attempting to circumvent booking rules, system controls, or administrative restrictions
• Use the Application solely for its intended purpose and in good faith

4. Account Responsibility

You are solely and exclusively responsible for all activities that occur under your Google account while authenticated to the Application. This includes, but is not limited to, all bookings, modifications, cancellations, and any other actions performed using your credentials.

If you suspect or become aware of any unauthorized access to your account, you must immediately notify a Poems Dimension administrator. Failure to report suspected unauthorized access in a timely manner may result in suspension or termination of your access privileges.

5. Administrator Rights

Poems Dimension administrators retain the absolute right to perform the following actions without prior notice or consent:

• View, modify, or delete any booking or reservation made through the Application
• Add or remove users from the authorized allowlist at their sole discretion
• Manage and configure available rooms, performance types, booking parameters, and system settings
• Suspend or terminate user access for any reason, including violation of these Terms

6. Service Availability

The Application is provided on an "AS IS" and "AS AVAILABLE" basis, without any warranty or guarantee of uptime, availability, reliability, or uninterrupted operation.

Poems Dimension expressly reserves the right to suspend, interrupt, modify, or terminate the Application or any portion thereof at any time and for any reason, with or without prior notice to users. This includes, but is not limited to, scheduled maintenance, emergency repairs, system upgrades, or business decisions.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Poems Dimension and Charoensook Corporate Group Co., Ltd. shall not be liable for any of the following types of damages arising from or related to your use of the Application:

• Indirect Damages — any damages that do not flow directly and immediately from a breach
• Incidental Damages — losses occurring as a side effect or byproduct of the primary harm
• Consequential Damages — losses resulting from subsequent events or consequences
• Special Damages — unique or particular losses specific to your circumstances
• Lost Profits or Revenue — any loss of business income or financial opportunity
• Loss of Data or Business Interruption — disruption to operations or loss of stored information

Consumer Protection Notice: This limitation of liability does not affect or diminish any statutory rights you may possess under the Consumer Protection Act B.E. 2522 (1979) of Thailand or any other applicable consumer protection legislation. Nothing in these Terms shall be construed to exclude or limit liability that cannot be lawfully excluded or limited under Thai law.

8. Amendments to Terms

Poems Dimension reserves the right to modify, amend, or update these Terms of Service at any time and at its sole discretion. Continued use of the Application following the posting of any changes shall constitute your acceptance of such modified Terms.

The date of the most recent revision will be clearly indicated at the top of this document. We strongly recommend that you review these Terms periodically to ensure you remain informed of any changes. Material changes may be communicated via email or in-application notification, but such notification is not required.

9. Governing Law and Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of the Kingdom of Thailand, without regard to its conflict of law provisions.

Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be subject to the exclusive jurisdiction of the courts of Thailand.
